SICICLANDOTM Policies, Terms and Conditions

Reservations, Deposits, and Payments

We are pleased to take you on a Siciclando tour. These Policies/Terms and Conditions outline the agreement between you, the client, and Soul Italy Inc. doing business as Siciclando (referred to as Siciclando herein after). When you indicate your intention to reserve a tour (by email or Hold My Spot), we will send you a link to our on-line reservation form.   A completed reservation form indicates your acceptance of our Policies/Terms and Conditions. We require 30% of the total trip cost per person as deposit to confirm your space.  The balance of the tour cost is due no later than 60 days before the tour departure. Once your full payment is received, we will send a Confirmation Letter with all the details included in the tour package so you can prepare for your tour.

When you have filled out the reservation form and we have contacted you about the deposit amount you have two payment options:
1) Credit card – You will receive an e-mail with instructions to pay the deposit or to pay the full tour price by credit card through our on-line secure server.   Important: We do not store credit card details nor do we share customer details with any 3rd parties, except otherwise provided under our Privacy Policy below.

2) Wire transfer — If you choose this payment option, we will provide you with instructions for the transaction.

 

Cancellation Policy

We understand that you may need to change your travel plans. If you are unable to take your tour with us after making a deposit or full payment, we will apply the following cancellation fee:

  • 60 days or more before the tour departure date – there will be a $150 administrative fee per person
  • 45/60 days before the tour departure date: cancellation fee of 30% of tour cost per person
  • 30/44 days before the tour departure date: cancellation fee of 50% of tour cost per person
  • 15/29 days before the tour departure date: cancellation fee of 75% of tour cost per person
  • 0/14 days before the tour departure date: cancellation fee of 100% of tour cost per person
  • No refunds are possible after the tour begins. Please note that any refund from Siciclando will be done within 30 days after the end of the scheduled trip.

You also have the option of applying your deposit or payment to another Siciclando tour during the same season. Each tour is priced differently. Your deposit or payment will be applied to the new tour of your choice and the balance will be adjusted accordingly.

In the unusual situation that Siciclando has to cancel a tour, you have the following options:

  • Siciclando will refund the full deposit
  • You can use the deposit for another Siciclando tour already confirmed during the same season
  • Keep in mind that each tour is priced differently. Your deposit or payment will be applied to the new tour of your choice and the balance will be adjusted accordingly.
  • You can run the trip as a self guided option, if the tour offers that option.

SICICLANDO is not responsible for other expenses incurred such as non-refundable plane tickets, if a tour is cancelled.

 

Insurance

Personal Travel Insurance

Siciclando strongly encourages/highly recommends guests purchase sufficient travel insurance to cover travel cancellation or delays as well as, medical expenses, personal liability, and personal belongings during travel. Siciclando is not responsible for illness, injury or damage to personal property unless there is negligence of the company.

Siciclando Liability Insurance

Liability insurance is held by our supplier of tour services, as agreed by accepting our terms and conditions.

 

Responsibility and Liability Release

Guests are responsible for choosing a tour that meets their physical and medical abilities. Your reservation is accepted based on the understanding that you realize and accept the risks associated with bicycle and hiking travel. You acknowledge that you are in sufficient good health and are able to undertake an active tour.

Please see the Liability Release Form which is required to reserve a Siciclando tour.

Reservations are only valid when we receive a completed and signed Release of Liability form. If we do not receive this by the time of final payment, your reservation will be canceled and we will maintain the deposit amount as per our cancellation policy.

 

Photographs

Guests grant Siciclando permission to take photographs or video during our tours for media use and for promotional and marketing purposes such as internet and printed materials and will not expect payment from Siciclando for use.

 

Itinerary Changes

Siciclando may change the itinerary due to unforeseen circumstances. This includes biking/hiking routes that may be affected by weather or other accessibility issues. We make every effort to maintain the itinerary keeping in mind our high standard of quality and safety. We appreciate your understanding.

 

Place of Jurisdiction

If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. Any unresolved controversy or claim arising from or relating to this contract or breach thereof shall be settled by arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules which Rules are deemed to be incorporated by reference into this clause. The number of arbitrator shall be one, appointed by AAA.

The place of mediation and arbitration shall be Denver, Colorado. The Colorado law shall apply. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. If all parties to the dispute agree, a mediator involved in the parties’ mediation may be asked to serve as the arbitrator. English shall be the language for the settle of any dispute through direct discussion, mediation or arbitration.

 

Privacy Policy

We care about protecting the information you share with us.  With this objective, we continually review and update our Privacy Policies and company protocols to ensure that we comply with US and European General Data Protection Regulation (GDPR) privacy regulations.

All the data we collect is necessary to maintain contact with you and to provide you with the best service. Siciclando fully protects your individual and private information.  First, we minimize the collection to only the necessary data (name, contact information, passport number, and physical information) required to complete transactions and provide services on tour. Second, we do not collect your financial information. For credit card payments we provide direct and secure links to merchant service companies, where you input your own information.

We also collect data through this website www.siciclando.com and through our electronic Reservation Form.  We may ask for some information by email or by phone.  All information goes directly to our secure server.  By contacting us, booking a tour, or in any other way sharing information with us, you are accepting and consenting for us to use your information as outlined in this policy.

 

Data Collection and Use of Personal Information

Website

Siciclando automatically collects some information about your visit to our website, through cookies.  Collected information may include: Internet Protocol (IP) address and domain name used, type of browser used, date and time you visited the website, and webpages and services that you accessed.

This data is used to improve the content of our services.  By accessing and browsing this website, you consent to the collection, use, disclosure, storage and processing of your information in accordance with the Privacy Policy.  All of this information is anonymous and does not identify individuals.  The information gives us marketing data such as number of visitors, general locations (city, region, country), frequency and duration of visits.  We use the information to help us with promotions and product development.

The internet industry regularly uses cookies which may be placed on your computer to collect information about your web visits.  Cookies are not linked to any personally identifiable information.  You can disable cookies by changing your browser settings to not accept cookies or to alert you when a cookie is sent to you.

Reservation Form

Siciclando collects personal information (name and surname, country, passport data, e-mail address, telephone number, physical information) submitted by you through our Reservation Form link and/or in the course of booking a tour or using related services.

We use this information to fulfill our obligations in providing our bike tour services. All information collected and held is on a secure server.

Electronic Newsletters

We may use your email address to send electronic newsletters.  You can decide not receive these at any time by unsubscribing at the bottom of the newsletter or by sending an email to info@siciclando.com.

 

Use of Images

During our tours, we may take pictures that are used for professional use only on our website, in electronic newsletters, or on social media.  You can decline to have your image used by choosing this option on the Reservation Form.

 

Transferring Data to Third Parties

We share your information only with authorized third parties necessary to provide services for your tour or in an administrative capacity.  This includes:

  • Tour providers including Bike Italy s.r.l., our sister Italian tour operator
  • Service providers (hotels, transportation companies, etc.)
  • Other individuals who provide services for your tour with us
  • Limited information may be viewed by our accountants and financial representatives on invoices and transaction receipts

 

Storage of Data

We process and store your data on our secure server.  Because most of our guests return on our tours within two years, we keep contact information.  We also store names and emails for our electronic email list.  We do not receive financial information from our clients, so we do not store credit card or banking information.

 

Security Measures

To prevent unauthorized access, to maintain data accuracy, and to ensure the appropriate use of any information supplied by you, Siciclando has put in place physical, electronic and managerial processes to protect your information.  Additionally, all user information stored on this website is protected from unauthorized access through the use of secure login information and security shields/procedures.

We ensure that Third Party contracts maintain proper controls to shield your personal data.  We share only the data needed for each specific tour service.

 

What You Can Do

You have the right to request access to your data we have on file and to ask for it to be deleted.  This will be done once our services to you have been completed or canceled and once all financial transactions are complete.  You can do this by writing to us at info@siciclando.com.
